How Long Does it Take to Get a Divorce in NC?

Many people who are going through a divorce want to get the process over with as quickly as possible. Like all other states, though, North Carolina has specific laws related to divorce, and how long it takes to get a divorce.

Can I get a quick divorce in NC?

Because divorce is often an emotionally exhaustive process, it’s understandable why most want it completed as quickly as possible.  Here are the required waiting periods and timeframes that must be satisfied for you to be divorced (becoming legally single again) in North Carolina:

  • You and your spouse must be separated for a year before either of you can file for divorce.
  • Either or both of you must have lived in North Carolina for at least six months before filing.
  • After one party has been served with divorce papers, they have 30 days to file a response. In fact, they can be granted an additional 30 days if they request it from the court.
  • Once the 30-60 day waiting period is over, a Motion for Summary Judgment can be filed and there will be a 3-5 week wait until the judge reviews the file and signs a final divorce judgment.

These mandated waiting periods are generally required in all North Carolina divorce cases, regardless of circumstances.

Can I speed-up my divorce in NC?.

While you’re waiting for the 1-year separation period to end, you can attempt to settle the issues of custody, child support, alimony, and property distribution.  If you’re successful at resolving these issues with your spouse, it will make the entire process quicker and easier.  But, if you can’t settle these issues, you’ll need to file a lawsuit and this will increase the timeframe greatly.
