Insurance adjusters will want to ask you questions to try and get you to admit that you were at fault for the accident. North Carolina has a law called CONTRIBUTORY NEGLIGENCE. IF YOU TELL ANYONE THAT YOU WERE AT FAULT, IN ANY AMOUNT, THEN CONTRIBUTORY NEGLIGENCE MAY PREVENT YOU FROM ANY RECOVERY FOR YOUR INJURIES.

  6. DO NOT put ANY photos or descriptions of your activities or ANY information about the accident on social media. Any such information will be used against you by Defense Attorneys or Insurance Companies.

  7. DO NOT mention lawyers or lawsuits at any time when talking to Hospital Staff or a medical providers.

How long does a person have after an automobile accident to file a lawsuit against a negligent party for a personal injury?

In North Carolina, the general rule is that in an action for damages for negligence a party has three-years under the statute of limitations from the time of the accident. If the accident causes a death, there is only a two-year statute of limitations for the wrongful death caused by the negligence of another. There are situations where these statute of limitations can be tolled. For example, if the injured party is a minor, the statute of limitations does not start to run until the minor reaches his or her eighteenth birthday. If the injured party is mentally incompetent under North Carolina law, then the statute of limitations is tolled until the person is declared by the Court to be competent.
